Jehovah's Witnesses in Tajikistan appeal to the Constitutional Court to protect their religious freedom

DUSHANBE, Tajikistan—On March 2, 2012, Jehovah’s Witnesses filed an application with the Constitutional Court of Tajikistan requesting that the decision by state authorities to “terminate” their registered religious organization be ruled unconstitutional.

 

Jehovah’s Witnesses have been active in Tajikistan for more than 50 years. They first received state registration in 1994. On October 11, 2007, Tajikistan’s Ministry of Culture unilaterally issued an order to “terminate” the activity of the registered religious organization of Jehovah’s Witnesses. The Witnesses’ public ministry and the concern that individual Witnesses might seek to substitute compulsory military service with alternative civilian service were cited as grounds for the order. However, the right to peacefully discuss religious beliefs, in public or in private, is guaranteed by the Tajik Constitution and international law, as is the right to request alternative civilian service.

 

Appeals by Jehovah’s Witnesses were dismissed by the trial court and Supreme Court, both concluding that the Ministry of Culture had the unilateral authority under the Law on Religion to terminate the activity of any religious organization. Subsequently, the Law on Religion was replaced by a new law that now prohibits state authorities from terminating the activity of a religious organization without a court order.

 

Jehovah’s Witnesses who are citizens of Tajikistan have been subjected to increasing harassment and threats by some officials who insist that the Witnesses cannot carry out their peaceful religious activity without state registration. Therefore, the Witnesses have appealed to the Constitutional Court, the highest judicial body in Tajikistan, for protection of their rights.

 

“Jehovah’s Witnesses respect the Tajik authorities,” states Mr. Vladimir Adyrkhayev, Chairman of the terminated organization. “We hope that the Constitutional Court will agree to hear our application and restore our legal registration.”

Dushanbe, Tayikistán, representantes de la Comisión Nacional de la Seguridad Nacional (SCN) y el Departamento de Dushanbe La policía allanó una reunión pacífica religiosa de los Testigos de Jehová celebraron en un apartamento privado el 22 de julio de 2011. Los funcionarios realizaron búsquedas de las pertenencias de los Testigos de personal, se apoderó de todos los de su literatura religiosa y gritó en el grupo, alegando que era ilegal que los testigos de Jehová que se reúnen.

El propietario de la vivienda junto con su madre y sus cuatro hijas (de 2 a 13) fueron llevados a la comisaría donde fueron interrogados durante casi siete horas. Tras su liberación, los cuatro jóvenes requieren atención médica para lidiar con el trauma resultante.

Los otros dos adultos en el grupo fueron detenidos e interrogados por la policía y los representantes SCN por más de 20 horas. Uno de los adultos detenidos se Sherzod Rahimov, de 24 años de edad, los Testigos de Jehová que sufre de una incapacidad permanente y puede caminar sólo con la ayuda de muletas. Fue interrogado por 15 agentes de policía quienes le exigieron renunciar a su fe, y golpeado en repetidas ocasiones. Rahimov sufría de mareos, dolores de cabeza y náuseas durante días después de los golpes recibidos. Cuando la policía se enteró de que Rahimov era un ciudadano de Uzbekistán, que insistió en que falsamente se le acusa de los delitos y amenazó con la tortura Rahimov poniéndolo en una silla eléctrica.

Rahimov habían vivido legalmente en Tayikistán con su madre y sus hermanos desde 2009. Antes de su detención, había solicitado la renovación de su visa. Sin embargo, el SCN tomó su pasaporte y no lo volverá a él hasta después de haber expirado. Rahimov se cargó con la violación artificial que no había podido renovar su visa y la de "ilegal" la actividad religiosa. Para ello, Rahimov fue deportado a Uzbekistán el 17 de agosto de 2011.

Estos actos de intolerancia religiosa por parte de funcionarios locales son contrarias a la garantía de la libertad de religión y asociación, consagrados en la Constitución de Tayikistán y los tratados internacionales ratificados por Tayikistán.
